1. About this agreement

These Club Terms of Service (Club Terms) are an agreement between Organise Me Group Pty Ltd trading as OMG Pro (ABN 64 615 556 324) (we, us) and the club, studio, school, business or organisation that claims a listing or buys a paid product (you, the club). The person accepting these terms confirms they are authorised to act for the club.

You accept these terms by ticking the box when you claim a listing or check out. Our Terms of Use and Privacy Policy also apply.

2. Our role

OMG Pro is an independent directory and advertising platform. We are not your partner, agent, employer or employee, and we do not run, supervise or inspect your activities. You are solely responsible for your activities, staff, volunteers, premises, programs, bookings and dealings with participants.

3. Your promises (warranties)

By claiming a listing, you confirm, and keep confirming while your listing is active, that:

the club holds an active ABN (or is otherwise lawfully constituted) and the ABN you give us is correct;

you meet the NSW Working With Children Check requirements under the Child Protection (Working with Children) Act 2012 (NSW) for every staff member and volunteer in child-related work, and you verify their clearances with the Office of the Children's Guardian;

you hold the insurance appropriate to your activities, including public liability insurance [minimum $10 million recommended, confirm], and will provide a certificate of currency if we ask;

you comply with laws that apply to your activities, including work health and safety, child safe and consumer laws;

everything in your listing (times, prices, ages, photos, claims) is accurate, not misleading, and you have the right to publish it, including written permission from parents for any photos of children.

Tell us within 7 days if any of these stop being true.

4. Your listing

Keep your listing accurate and up to date.

We may edit listings for format, accuracy or to meet these terms, and we may decline content.

You give us a licence to display your listing content, name and logo on OMG Pro and in OMG Pro marketing about the directory.

Enquiries from parents are sent to you. Use them only to respond to that enquiry and in line with privacy law. Don't add parents to marketing lists without their consent.

All prices are in Australian dollars and include GST. Payments are taken by card through Stripe at checkout. [Confirm Organise Me Group's GST registration.]

Top Spot rules. Top Spots are available to Plus Priority members only, in a maximum of 2 areas at a time. A holder may renew for the next block only if no other club is on that spot's waitlist. Waitlisted clubs are offered free spots in order and have 48 hours to book. A booked price is locked once paid. Featured placements are labelled and appear only in the area and activity group booked.

6. Cancellations and refunds

Plus Priority: cancel at any time in your dashboard. Monthly plans end at the end of the current month; yearly plans end at the end of the current year. We don't give part-refunds for unused time, except as required by law.

Top Spots and Spotlight: you can cancel for a full refund up to 7 days before your block or week starts. After that, bookings are non-refundable because the spot is held for you and other clubs miss out.

Our faults: if OMG Pro fails to show your paid placement for a material period because of our error, we'll extend your placement or refund the affected time.

Nothing in these terms excludes rights you have under the Australian Consumer Law.

7. Suspension and removal

We may suspend or remove your listing, badge or paid placement, immediately if needed, if:

we receive a credible safety complaint about the club, or we are told of a concern by a regulator or police;

a verification check fails, or any promise in section 3 is untrue;

you breach these terms or misuse parent enquiries.

Where we suspend because of a safety concern, we'll tell you why where it is lawful and safe to do so, and give you a chance to respond before permanent removal. If we remove a paid placement because of your breach, no refund is payable. If we remove it for another reason, we will refund unused paid time.

8. Indemnity

You indemnify Organise Me Group Pty Ltd against claims, losses and costs (including reasonable legal costs) arising from your activities, your staff and volunteers, your premises, any injury or incident at or in connection with your activities, inaccurate listing content, or your breach of these terms, except to the extent the loss is caused by our own negligence or breach.

9. Limiting our liability

To the extent the law allows, our total liability to you under these terms is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss, including lost enrolments or profit.

10. Ending this agreement

You can unclaim your listing at any time by contacting us. The listing may remain on OMG Pro as an unclaimed listing showing public information, unless you ask us to remove it and we agree. Sections 3, 8 and 9 continue after this agreement ends.

11. Changes

We may change these terms or our prices. We'll give you at least 30 days' notice by email of any change that affects you. Price changes don't affect a block or period you have already paid for. If you don't agree, you may cancel before the change takes effect.
